Governor Banwarilal Purohit had canceled the one-day special session of the state assembly called by the Punjab government for the trust vote. After allegations of horse-trading by Aam Aadmi Party (AAP) MLAs on the BJP, the Chief Minister Bhagwant Mann government had decided to convene a special session for a day on Thursday. After letters from the opposition, the governor withdrew his permission, citing rules.

Issuing an order in this regard on Wednesday evening, the Governor wrote that due to lack of specific rules in the decision to convene the session of the Legislative Assembly only with a view to securing the trust vote, I am withdrawing my order under which 20 Permission was granted to convene the third special session of the 16th Punjab Legislative Assembly on September.

Decision to call canceled session on this basis

In a letter sent by JM Balamurugan, Special Secretary to the Governor, to Surinder Pal, Secretary, Punjab Legislative Assembly, it has been said that on Wednesday, Leader of the Opposition Pratap Singh Bajwa, MLA Sukhpal Singh Khaira and MLA and Punjab BJP President Ashwini Sharma gave It was pointed out in the representation that there is no legal provision for convening a special session only for the purpose of bringing a vote of confidence in favor of the State Government. Legal opinion was taken from Satyapal Jain, Additional Solicitor of India on this representation. In his opinion, he said that under the Rules of Procedure and Conduct of Business in the Punjab Legislative Assembly, there is no provision of any specific rule for convening the assembly session only for the consideration of the motion of confidence. Keeping this legal opinion in mind, the Governor has withdrawn his September 20 order convening a special session of the Legislative Assembly.
